Terms and Conditions

These general terms and conditions (the "General Terms and Conditions") govern the relationship between Vamos in Sailing ("Vamos"), and the users (the "Users") identified when requesting a booking, purchasing a gift card or purchasing from the online store (the "Account"), for the use of the websites, applications and related services operated by Vamos (the "Platform").
Vamos Platform offers a virtual meeting place for people who love sea and nature to share experiences (the "Experiences"): the Users who publish and organize the Experiences are the "Providers", while the Users who search and book the Experiences are the "Travellers".
The use of the Platform is also governed by specific conditions of use of the Platform (the "Platform Terms of Use"), by the Traveller Policy and Provider Policy (the "Policies") by particular recommendations (the "Code of Conduct") and by the privacy policy (the "Privacy Policy"), which form an integral part of these General Conditions (together with these General Conditions, the "Agreement").
1. PLATFORM REGISTRATION
Vamos, following registration to the Platform in accordance with the provisions of the Terms of Use of the Platform, grants the User to use the services offered by the Platform, in accordance with the provisions of the Agreement.
You represent and warrant that you have provided accurate, truthful, current and complete information regarding your identity, age, gender, boating experience and skills and your personal information in general. Vamos assumes no responsibility for the accuracy and completeness of the information provided by Users. In no event shall Vamos be liable to you or any third party for any damages resulting from inaccurate or incomplete information provided by you.
2. PUBLICATION OF AN EXPERIENCE
Each User, after having applied for accreditation and having been enabled, can ask Vamos to publish his/her own Experiences on the Platform, within a page dedicated to each of them (the "Experience Page"), and propose them to other Users, thus assuming the status of Provider. The Provider may be an individual, either private or professional, or a subject representing an organization such as, for example, a sports association, a charter company or a tour operator.
The Provider, in order to propose an Experience, must specify the characteristics of the Experience, such as, but not limited to: departure date, duration, destination, number of places available, itinerary, and for sailing experiences, the characteristics of the boat used. The Provider is obliged to promptly inform all Travellers participating in the Experience (the "Crew") of any variation of the same, in order to guarantee an informed choice on the part of the Crew. It is understood that, for reasons of force majeure, such as, but not limited to, weather conditions and decisions of the competent maritime authorities, or for reasons related to the safety of the boat and/or its occupants, the Provider may, at its sole discretion, modify the characteristics of the Experience, even during the course of the Experience.
In conjunction with the above information, the Provider must indicate, for each Published Experience:
o the minimum number of people who must participate in the Experience in order for it to be confirmed (the "Minimum Crew");
o the price to participate in the Experience (the "Share Price"), expressed as a price per person;
o any discounted price to be applied to the first Travelers who book the Experience or who book by a certain date (the "Quota Early Booking Price"); and/or
o for sailing experiences only, the price for reserving the entire boat (the "Entire Boat Price");
the Quota Price, the Early Booking Price of the Quota and the Whole Boat Price hereinafter also alternatively referred to as the "Experience Price").
The Provider is responsible for determining which services are included in the Experience Price. For sailing experiences, the boat and skipper must always be included in the Experience Price.
The Provider also undertakes to promptly update the number of seats available for each Experience published, to guarantee the actual availability of the same and, in any case, to give boarding priority to Travellers over any third parties.
3. CONFIRMATION OF EXPERIENCE
An Experience, unless already confirmed by the Provider at the time of publication, will be deemed confirmed (the "Confirmed Experience") if any of the following conditions are met:
a. upon reaching the Minimum Crew specified by the Provider at the time the Experience is published on the Platform;
b. following confirmation of the Experience by the Provider at any time prior to departure, regardless of whether the Minimum Crew has been reached.
When a previously unconfirmed Experience becomes Confirmed, all Travellers on board receive an email notification confirming this status change.
The Provider,once the Experience becomes Confirmed, may not cancel it and agrees to perform it in accordance with the provisions of Article 2, paragraph 2, subject to the provisions of the Traveller Policy and Provider Policy.
4. OBLIGATIONS AND RESPONSIBILITIES OF THE PROVIDER
The Provider is solely responsible for the organization of the Experience, which must be carried out in accordance with the characteristics of the Experience indicated to Users, subject to the provisions of article 2, paragraph 2. Vamos assumes no responsibility for the organization and success of the Experience.
The Provider is solely responsible for the selection of the vessel and the means, accommodation, equipment and anything else used for the purposes of the Experience, its safety and compliance with applicable regulations. If the Provider does not use its own vessel, the Provider assumes the burden of signing the relevant contract with third parties for the charter or rental of the vessel. It is understood that under no circumstances shall Vamos be liable for the Provider's failure to fulfill its obligations under such contracts.
Under no circumstances may the Provider propose or in any way divert Users to services other than those made available through the Platform, thereby circumventing the payment system described in article 4 below or, in any case, receive payments in a manner other than those made available through the Platform. Violation of this commitment by the Provider constitutes a serious breach of the Agreement and the person responsible will be subject to the penalty stipulated in article 3 of the Platform's Conditions of Use.
The Provider represents and warrants that he/she is in possession of all licenses, certifications, and authorizations necessary for the conduct of the Experience, that he/she is aware of and will comply with all applicable laws in the areas where the Experience is taking place, and that he/she has fulfilled any administrative or fiscal obligations required by applicable law in the areas where the Experience is taking place. Vamos does not guarantee the truthfulness of the statements made by the Provider and is exempt from any liability to Users and any third parties in connection with or arising out of any false or incomplete statements made by the Provider or in connection with the Experience.
Under no circumstances may the Provider demand payment from the Crew of any sums in excess of the amount paid by each member of the Crew at the time of booking, with the exception of the extra costs indicated on the Experience Page, which shall be divided among all members of the Crew, excluding the Provider. Breach of this commitment by the Provider shall constitute a serious breach of the provisions of this Agreement and shall be sanctioned by a penalty of ten times the amount unduly received.
In the case of Sailing Experiences, the Provider will assume command of the boat used for the Experience, with the consequent responsibilities, inter alia, civil and criminal, towards the Crew and third parties.
In the case of Sailing Experiences, the Provider, as captain of the boat used, undertakes to provide adequate information to all embarked Travellers, before the boat leaves its moorings from the port of embarkation, regarding the rules of behaviour, the use of equipment on board, the manoeuvres in which they may be required to participate, the position and use of personal and collective safety equipment and the procedures to be adopted in case of emergency.
The Provider's information obligations at the time of departure/start of each Experience vis-Ă -vis participating Travellers, as set out in paragraph 7 above, are generally applicable to all types of Experience.
5. OBLIGATIONS AND RESPONSIBILITIES OF THE TRAVELLER
Due to the nature of the Experiences published on Vamos, the Traveller is required to notify the Provider, prior to booking, of any special physical condition that may affect the Traveller's safety during the Experience, i.e. any form of motor disability or condition of reduced mobility - permanent or temporary - such as, but not limited to, a broken or missing limb or muscular dystrophy (the "Special Condition").
Once the Special Condition is disclosed, the Provider is responsible for assessing whether the Traveller's enjoyment of the Experience can take place without compromising the safety of the Traveller and the Crew, and for communicating its assessment to the Traveller. Should the Special Condition occur after the booking but before the departure of the Experience, the Traveller must inform the Provider immediately to enable the Provider to assess the situation.If the Provider is not notified of the Special Condition prior to booking, if the booking is made despite the Provider's negative assessment of the ability to safely participate in the Experience, or if the Special Condition occurs after booking, the Provider has the right to deny the Traveller the use of the Experience if the Provider believes that the Special Condition may affect the safe conduct of the Experience. In this case, the Traveller shall not be entitled to a full or partial refund of any monies paid.
However, prior to participating in the Experience, the Traveller is required to notify the Provider of other special conditions such as, but not limited to, pregnancy, severe allergies, or the need to take life-saving medications, so that the Provider is aware of any conditions requiring specific attention and the Experience can be conducted safely.
6. SERVICE COSTS
Vamos reserves the right to charge Users, in addition to any applicable taxes, fees for the use of the Platform each time a reservation is confirmed. Vamos also reserves the right to change these charges at any time: changes will not affect bookings made before the relevant effective date.
Applicable tax is defined as any sales tax, value added tax (VAT), goods and services tax, tourist tax, fees, as well as other similar indirect taxes or other withholding and tax on personal or corporate income which Vamos, under applicable laws, may have to collect and remit to the relevant tax agencies.The fees that Vamos charges for the use of the Platform (collectively, the "Service Fees") are divided into fees charged to Travellers (the "Traveller Service Fee") and fees charged to Providers (the "Provider Service Fee"), and vary according to the value of the Experience Price. Depending on the laws of the relevant jurisdiction, VAT may be charged on Service Fees: therefore, where applicable, Service Fees will include VAT.
7. BOOKING AND PAYMENT OF THE EXPERIENCE
The Provider may, before the Traveller makes the reservation, agree with the Traveller, exclusively through the tools provided by the Platform, on a different price value for the Experience than the one published on the Experience Page, valid for the reservation of a specific number of seats or, for sailing experiences only, for the entire boat (the "Custom Offer Price").
During checkout, at the value determined by applying, alternatively:
i. The Quota Price or the Early Booking Price of the Quota, multiplied by the number of seats selected, or
ii. The Whole Boat Price, or
iii. the Custom Offer Price
(the "Gross Amount of the Reservation") are applied eventual discounts paid by Vamos (the "Vamos Discounts"), such as those deriving from the use of coupons. Subsequently, the Traveller has the option to select, upon the occurrence of certain conditions, one or more additional paid services offered by Vamos (the "Vamos Additional Services"), including:
iv. Extended Refund Conditions: the Traveller may extend the cases for which he has the right to receive a refund in case of cancellation of his reservation, as better specified in the Traveller Policy;
v. Payment in instalments: you can pay a deposit at the time of booking and the balance within 30 days from the date of departure.
To finalize the reservation of the Experience, the Traveller is required to pay the Gross Amount of the Reservation, plus the Traveller's Service Fee and the cost of the VamosAdditional Services, minus the Vamos Discounts (altogether the "Total Reservation Amount").
Vamos relies on an external service (the "Payment Platform") to manage electronic payments related to the bookings of the Experiences. The services operated by the Payment Platform are provided primarily by Stripe Inc. ("Stripe") and PayPal Inc. ("PayPal") and are subject to the terms of the Stripe Connected Account Agreement (Stripe Connected Account Agreement) and PayPal (Payapl Connected eAccount Agreement), which includes the Stripe Terms of Service and PayPal Terms of Services, collectively referred to as the "Stripe Services Agreement" ("Stripe Services Agreement") and the "PayPal Services Agreement" ("PayPal Services Agreement"). By accepting the Agreement or continuing to operate as a User of the Platform, You agree to be bound by the Stripe Services Agreement and PayPal and any amendments made by Stripe and PayPal from time to time.
Payment of the Total Reservation Amount must be made by the Traveller via the Payment Platform in order to ensure the security of the transaction. The Provider appoints the Payment Platform as its temporary payment collection agent for the sole purpose of receiving the Gross Reservation Amount. The Provider agrees that the payment made by the Traveller shall be deemed to be a payment made directly to him/her.
8. CANCELLATION AND REFUNDS
The terms applicable to cancellation of a booking by the Traveller or Provider and the relevant refund policies are described in the Traveller Policy and the Provider Policy, which form an integral part of these Terms and Conditions.
9. PROBLEMS ENCOUNTERED DURING THE EXPERIENCE
Without prejudice to the provisions of articles 6, 7 and 8, the Traveller will not be entitled to any reimbursement, in whole or in part, of the amount paid for the reservation of an Experience if, due to force majeure, bad weather or other factors, the full enjoyment of the Experience or the execution of the planned program is jeopardized.
10. PAYMENT OF THE GROSS AMOUNT OF THE RESERVATION
The Provider, in order to receive the Gross Reservation Amount collected on its behalf, must first provide its payment and billing information and promptly inform Vamos of any subsequent changes. The Provider, therefore, undertakes to provide this information at the latest at the time of publication of the first Experience on the Platform. In case of failure to provide or late provision of such information, Vamos reserves the right to delay, at its sole discretion, the payment of the Gross Reservation Fee to the Provider. Furthermore, in the event that the payment details provided are incorrect or out of date, Vamos reserves the right to charge the Provider the additional costs - administrative and bank commissions - incurred. Vamos assumes no responsibility for the accuracy or veracity of the payment and billing information provided by the Provider.
The Gross Reservation Fee, net of the Provider's Service Fee, will be paid to the Provider two working days after departure of the relevant Experience.
11. OBLIGATIONS AND RESPONSIBILITIES OF VAMOS
Vamos undertakes to provide the Platform management service in accordance with the Agreement. It is understood that Vamos provides only a management service of the Platform, not being in any way part of the relationship established between Traveller and Provider. In particular Vamos does not provide any service related to the booking and/or supply of:
i. cruises by ship or pleasure boat, including any additional services provided by skipper and hostess;
ii. ships or recreational craft;
iii. tourist packages, hotel, transport and/or catering services. Any catering or cooking service, if provided for in the agreements, will be served by specific authorized Provider.
Vamos does not verify the authenticity of the information provided by Users. In no event shall Vamos be held liable for the data, information and/or content provided by Users, whether or not publicly accessible, for the inaccuracy of such data, information or content, for any errors or omissions they may contain, or for any damages, caused to Users or third parties, resulting from the use of the data, information and/or content displayed or transmitted by any User through the Platform.
VAMOS, IN ITS CAPACITY AS MERE MANAGER OF THE PLATFORM, ASSUMES NO RESPONSIBILITY FOR THE ORGANIZATION AND SUCCESS OF THE EXPERIENCES PUBLISHED ON THE PLATFORM. THE PROVIDER REMAINS, THEREFORE, IN ACCORDANCE WITH THE PROVISIONS OF ARTICLE 4, SOLELY AND EXCLUSIVELY RESPONSIBLE FOR THE ORGANIZATION AND SUCCESS OF THE PROPOSED EXPERIENCES.
The eventual cancellation of an Experience or a reservation by the Traveller or the Provider, cannot in any way be attributed to Vamos, as it exclusively concerns the relationship between Traveller and Provider. Therefore, any liability of Vamos in relation to the cancellation of Experiences or bookings is excluded, without prejudice to the reimbursement obligations referred to in Articles 7 and 8.
12. DURATION AND TERMINATION
This Agreement between Vamos and User comes into effect at the time of User's booking request, or request for vacation posting, and remains in effect until terminated by User or Vamos.
The User may terminate the Agreement at any time by requesting the cancellation of the holiday, or the request, by sending a request via email to Vamos. From the moment the User receives the email confirming the cancellation, the User will no longer be allowed access to the Platform.
Vamos may, at its sole discretion, suspend access or temporarily restrict your use of the Platform in the event of suspected non-compliance by you with the Agreement.
In case of violation by the User of the provisions of the Agreement, Vamos reserves the right to terminate the contract in accordance with Article 1456 of the Italian Civil Code, restricting the use, suspending or deleting the Account of the User responsible for the breach, without prejudice to the request for the penalty referred to in Article 3 of the Platform Terms of Use, as compensation for damages.
Following the suspension or cancellation of an Account, any reservations associated with it - if the Account is associated with a Traveller - and any published Experience, and reservations associated with it - if the Account is associated with a Provider - may be cancelled by Vamos, at its sole discretion. The Traveller shall not be entitled to any refund and the Provider shall not be entitled to any payment for bookings cancelled as a result of the suspension of its Account. In the event that the Account is associated with a Provider, moreover, Vamos, in relation to the Experiences published by the Provider, reserves the right to:
o Notify Crews that their reservation has been cancelled;
o Reimburse Crews in full, regardless of cancellation terms;
o Contact Crews and inform them of alternative Experiences available.
It is understood that you are responsible for all activities carried out through your Account until you delete your Account.
13. CONFIDENTIALITY AND PERSONAL DATA
Personal data concerning Users are processed in accordance with the provisions of EC Reg. 27.04.2016, No. 2016/679/EU, as better specified within the Privacy Policy.
14. CONTRACT AMENDMENTS
These Terms and Conditions, together with the terms and policies which form an integral part of them, as defined in the introduction, constitute the sole agreement between the parties and supersede any prior or contemporaneous written or oral contract with reference to the same subject matter.
Vamos reserves the right, in order to improve the quality of its services, to modify the Agreement at any time.
In case of changes to the documents forming an integral part of the Agreement, Vamos will publish the updated version of the document(s) on the Platform, simultaneously updating the "Last Updated" date of the affected document(s). If the User does not agree with the changes, he/she may terminate the Agreement immediately, in accordance with the provisions of Article 11 above. In the event that the User does not terminate before the date on which the changes become effective, access to or use of the Platform will constitute acceptance of the Agreement, as modified.
15. REFUNDS
If a party fails to enforce any provision of the Agreement or any right thereunder, such failure shall not be deemed a waiver and shall in no way affect the validity of the Agreement. Any waiver or inability by either party to exercise any provision or right under the Agreement shall not preclude or impair any subsequent exercise of such provision or right.
16. PARTIAL INVALIDITY
If any term, condition, clause or provision contained in the Agreement is held by a court of competent jurisdiction to be invalid or unenforceable, such invalidity shall not affect the validity or enforceability of the other terms, conditions and provisions and the invalid term, condition or provision shall be deemed not to be included in the Agreement.
17. APPLICABLE LAW AND JURISDICTION
These General Terms and Conditions and their conclusion, interpretation and validity shall be governed by Italian law.
In the event that a User who is a natural person uses the Platform for a use which may be considered to be outside of their professional activity, hereafter also referred to as a "Consumer", if the mandatory consumer protection laws in force in the User's country of residence contain provisions which are more advantageous to the User, these provisions will apply in any case, regardless of whether or not the User chooses to use the laws of their country of residence (the "Mandatory Provisions").
The Court of Milan, Italy, shall have exclusive jurisdiction and territorial competence over disputes relating to or arising from the execution of the Agreement.
Notwithstanding the aforementioned jurisdiction clause, a Consumer may also bring an action for enforcement of the Mandatory Provisions in a court in the country in which he or she is domiciled. For Consumers in the European Economic Area, it is also possible to submit a complaint via the European Commission's online dispute resolution platform, which can be reached at this address: http://ec.europa.eu/odr.
18. ACCEPTANCE OF THE AGREEMENT
The use of the Platform is subject to the User's acceptance of the Agreement, which is deemed to be accepted at the moment of registration to the Platform.
The acceptance of the Agreement is integral. The User may not, therefore, choose to apply only a part of it or make specific reservations about it.
Pursuant to and for the purposes of articles 1341 and/or 1342 of the Italian Civil Code, the User expressly declares to accept the following clauses of these General Conditions:

Platform Terms of Use

1. REGISTRAZIONE ALLA PIATTAFORMA
Per richiedere la registrazione alla Piattaforma l’Utente deve aver raggiunto i 18 anni o la maggiore età prevista dal proprio stato di nazionalità per il legittimo esercizio dei diritti.
Per richiedere la creazione del proprio Account, l’Utente deve compilare l’apposita procedura presente sulla Piattaforma e, contestualmente, prendere visione ed accettare integralmente le Condizioni Generali e gli altri termini e condizioni che ne formano parte integrante, quali: (i) le presenti Condizioni di Utilizzo della Piattaforma, (ii) le policy relative ai Traveller (la “Traveller Policy”) e ai Provider (la “Provider Policy”), (iii) il Codice di condotta e (iv) la Privacy Policy (complessivamente, l’“Accordo”). In caso di mancata accettazione integrale dell’Accordo, all’Utente sarà precluso l'accesso alla Piattaforma.
L'Utente è l'unico responsabile dell'uso del proprio Account e dei propri dati identificativi, nonché l’unico soggetto responsabile della riservatezza dei dati stessi.
L'Utente garantisce a Vamos, con riferimento alle informazioni indicate nel proprio profilo, all’atto della registrazione o in un momento successivo, di aver fornito informazioni esatte, veritiere, aggiornate e complete in merito alla propria identità , età , sesso, esperienza e capacità e ai propri dati personali in genere. L'Utente s'impegna ad aggiornare tempestivamente il proprio profilo con tutte le informazioni che lo riguardano e a preservarne l'accuratezza, nel proprio interesse ed in considerazione delle finalità della Piattaforma.
L'Utente è responsabile del proprio account Vamos ed è obbligato a custodire con cura i propri dati di accesso in modo da prevenire accessi non autorizzati alla Piattaforma per il tramite del suo Account. In ogni caso, l'utente sarà responsabile di quanto fatto tramite il proprio Account da terzi. l’Utente è tenuto ad informare immediatamente Vamos in merito a qualsiasi utilizzo non autorizzato del proprio Account nonché a qualsiasi violazione della riservatezza e sicurezza dei propri mezzi di identificazione.
Vamos concede all'Utente il diritto non esclusivo, personale e non trasferibile di utilizzare la Piattaforma, nonché le informazioni ivi contenute, conformemente alle finalità della Piattaforma e nel rispetto delle previsioni contenute nell’Accordo. Qualsiasi altro impiego o utilizzo della Piattaforma e delle informazioni ivi contenute diverso dalle predette finalità è vietato.
2. CONTENUTI GENERATI DALL’UTENTE
L’Utente può chiedere di pubblicare contenuti e scambiarsi informazioni con altri Utenti tramite le funzionalità della Piattaforma quali, ad esempio:
a. Provider e Traveller hanno la possibilità di scambiarsi messaggi relativi all’organizzazione di una Esperienza. In nessun caso ai Provider e ai Traveller è consentito pubblicare e/o scambiarsi tra loro dati di contatto personali quali, a titolo esemplificativo e non esaustivo, numeri di telefono, indirizzi, account di servizi di messaggistica (i.e. Skype, Whatsapp, etc.), profili su Social Network, siti internet o blog personali o aziendali, etc., prima dell’acquisto dell’Esperienza;
b. I Traveller, al termine di una Esperienza a cui hanno preso parte, possono lasciare una recensione sull’Esperienza tramite le funzionalità rese disponibili dalla Piattaforma.
Vamos ha facoltà e piena discrezionalità sulla pubblicazione, caricamento, inoltro, invio e trasmissione dei contenuti pubblicati dagli Utenti. L’Utente accorda, inoltre, a Vamos una licenza mondiale, irrevocabile, perpetua, non esclusiva, trasferibile, priva di diritti d'autore, insieme al diritto di fornire in sublicenza, utilizzare, visualizzare, copiare, adattare, modificare, distribuire, concedere in licenza, vendere, trasferire, mostrare pubblicamente, trasmettere, trasmettere in streaming, diffondere, accedere, visionare e altrimenti sfruttare tali contenuti dell’Utente su, attraverso o per mezzo della Piattaforma. In qualsiasi caso, Vamos non rivendica alcun diritto di titolarità sui contenuti dell’Utente e non vi sono limitazioni ai diritti che l'Utente potrebbe avere di utilizzare o sfruttare detti contenuti.
L’utente è l’unico responsabile di tutti i contenuti resi disponibili attraverso la Piattaforma.
Vamos si riserva il diritto di rimuovere qualsiasi contenuto pubblicato in violazione di quanto disposto dall’art. 4 che segue.
3. OBBLIGHI DELL’UTENTE E PENALI
L’Utente, nell’utilizzo della Piattaforma, si impegna a:
a. comunicare informazioni esatte, veritiere e complete all'atto della registrazione alla Piattaforma, nonché nel corso dell’utilizzo della stessa, con particolare riferimento alla propria identità , età , esperienza e capacità , e al possesso di eventuali abilitazioni per la conduzione di navi e imbarcazioni e, più in generale, di tutte le abilitazioni, autorizzazioni e permessi richiesti per proporre le Esperienze sulla Piattaforma;
b. non utilizzare identitĂ false finalizzate a nascondere la propria identitĂ ;
c. non attivare piĂą di un Account riconducibile alla stessa persona, anche utilizzando indirizzi mail o profili facebook diversi;
d. rispettare la normativa vigente applicabile;
e. utilizzare la Piattaforma esclusivamente in conformitĂ agli obiettivi della Piattaforma, alle vigenti disposizioni di legge, alle presenti Condizioni di Utilizzo della Piattaforma, alle Condizioni Generali, alla Privacy Policy e al Codice di Condotta;
f. rispettare i diritti di proprietà intellettuale pertinenti ai contenuti forniti da Vamos e dagli altri Utenti, nonché i diritti di proprietà intellettuale di terze parti; pertanto, l’Utente deve astenersi dal riprodurre e/o comunicare attraverso la Piattaforma contenuti senza l'autorizzazione dei titolari dei diritti pertinenti a detti contenuti, quando tale autorizzazione è richiesta;
g. comunicare a Vamos e agli altri Utenti solo informazioni la cui distribuzione non possa, in nessun caso, danneggiare altri Utenti, Vamos o terze parti;
h. non pubblicare informazioni o contenuti di natura diffamatoria, oscena, offensiva o violenta o che inciti alla violenza, oppure di natura politica, razzista o xenofoba e, in generale, i contenuti che potrebbero essere contrari alle leggi e alle norme applicabili o alla pubblica decenza o che violino i diritti di Vamos o di terze parti;
i. non pubblicare informazioni o contenuti destinati a ridurre o ostacolare il normale utilizzo della Piattaforma, oppure interrompere e/o rallentare il normale flusso di comunicazioni tra gli Utenti;
j. non pubblicare recensioni che non rappresentino l'esperienza personale di colui che la scrive;
k. non pubblicare recensioni incentivate da promesse di pagamenti, servizi aggiuntivi o tariffe scontate;
l. non pubblicare recensioni motivate da una minaccia di estorsione (ad es. la minaccia di una recensione negativa nel tentativo di costringere un Provider a concedere un rimborso);
m. non proporre agli Utenti esperienze, servizi di locazione e noleggio di imbarcazioni o altri servizi analoghi a quelli pubblicati su Vamos, al di fuori della Piattaforma;
n. non partecipare o organizzare un’Esperienza eludendo il sistema di prenotazione e pagamento messo a disposizione dalla Piattaforma;
o. non indirizzare gli Utenti su altri siti o servizi non gestiti da Vamos;
p. non utilizzare la Piattaforma per pubblicizzare e/o promuovere altre attivitĂ commerciali o servizi di terze parti;
q. non proporre, accettare o effettuare un pagamento per un’Esperienza al di fuori della Piattaforma. In tali circostanze l’Utente si assume ogni rischio e responsabilità associate a tale pagamento e si impegna a tenere Vamos indenne da qualsiasi responsabilità in relazione a tale pagamento;
r. non raccogliere informazioni relative agli Utenti che siano utilizzate per inviare loro sollecitazioni di carattere commerciale o equivalente.
In caso di violazione da parte dell’Utente delle disposizioni di cui ai punti 13, 14, 15, 16 che precedono, l’Utente responsabile della violazione sarà tenuto al pagamento di una penale pari a ad Euro 10.000,00 (diecimila/00) per ogni violazione rilevata.
In caso di violazione da parte dell’Utente delle disposizioni del presente articolo e, in ogni caso, qualora la sua condotta rechi danno a Vamos, agli altri Utenti della Piattaforma o a terzi, oppure pregiudichi l'utilizzo della Piattaforma da parte di altri Utenti, Vamos si riserva, a suo insindacabile giudizio, il diritto di cancellare o sospendere l'Account dell’Utente, eliminare gli eventuali contenuti pubblicati in violazione di quanto sopra, bloccare l'accesso alla Piattaforma o a una sua parte, in via temporanea o definitiva, e senza alcun diritto al risarcimento da parte dell’Utente.
L’Utente é invitato a riportare a Vamos qualsiasi comportamento o contenuto sulla Piattaforma che sia manifestamente contrario alle norme esposte, affinché possano essere adottati gli opportuni provvedimenti, a tutela di Vamos e degli Utenti della Piattaforma.
4. RESPONSABILITÀ DELL’UTENTE
L'Utente ha la responsabilitĂ di assumere tutte le precauzioni idonee a tutelare i propri dati, i sistemi e/o il software utilizzati per accedere alla Piattaforma da infezioni di possibili virus, malware e attacchi informatici in genere.
L'Utente è l'unico responsabile dell'utilizzo delle informazioni, dei messaggi o dei dati di qualsiasi genere disponibili attraverso la Piattaforma, e in nessun caso qualsiasi parte diversa dall'Utente potrà essere ritenuta responsabile delle decisioni assunte o delle iniziative intraprese dall'Utente in base a tali informazioni.
L'Utente è, inoltre, l'unico responsabile dell'utilizzo fatto della Piattaforma e, più in generale, di qualsiasi altro utilizzo o azione compiuta tramite il proprio Account.
L'Utente è responsabile di tutti i dati e i contenuti che ha reso disponibili sulla Piattaforma.
5. LIMITAZIONE DI RESPONSABILITĂ€ DI VAMOS
Vamos ha la facoltà di cambiare, modificare ed aggiornare in qualsiasi momento i contenuti della Piattaforma senza necessità di previa comunicazione all’Utente e non potrà essere ritenuta responsabile di eventuali errori, imprecisioni, omissioni che si dovessero riscontrare nei contenuti della Piattaforma.
Vamos non è responsabile: (i) per l’eventuale trasmissione sui dispositivi dell’Utente di eventuali virus e contenuti comunque dannosi originati da terzi; (ii) per temporanee sospensioni o interruzioni della Piattaforma; (iii) di alcuna conseguenza derivante dall’uso che l’Utente farà delle informazioni, dei contenuti e dei dati ottenuti tramite la Piattaforma; (iv) nei confronti di terzi in ordine alla violazione, da parte dell’Utente, delle suddette disposizioni a carattere assolutamente inderogabile; (v) di qualsiasi perdita o danno derivante o in qualunque modo collegato all’uso ed al funzionamento della Piattaforma, ivi compresi, senza limitazione alcuna, danni per perdita di affari, perdita di utili, interruzione dell’attività , perdita di informazioni commerciali ovvero qualsiasi altro tipo di perdita pecuniaria.
Vamos non ha alcun obbligo generale di monitorare i dati e i contenuti forniti dagli Utenti, né ha alcun obbligo di cancellare i contenuti che potrebbero apparire non manifestamente illeciti, indipendentemente dal fatto di essere stata informata o meno in merito a detti contenuti. Vamos non è altresì responsabile dei contenuti di siti internet di terze parti ai quali possano reindirizzare i collegamenti di ipertesto presenti sulla Piattaforma.
In nessun caso Vamos potrà essere ritenuta responsabile per qualsiasi danno derivante da errori, omissioni o inesattezze contenute nelle informazioni fornite da un Utente, all’atto della registrazione alla Piattaforma o in un momento successivo.
L’Utente si impegna a manlevare e tenere comunque indenne Vamos da qualsiasi responsabilità , perdita, azione, procedura, costo, spesa, onere o danno di qualsiasi natura (inclusi i costi e le spese legali eventualmente sostenuti per agire c/o resistere in giudizio), da essi subito o che gli stessi dovessero subire, derivante o comunque connesso, direttamente o indirettamente, al presente accordo, nonché da qualsiasi conseguenza - anche di carattere legale e fiscale - che potesse sorgere nei confronti di Vamos e da qualsiasi azione venisse comunque e da chiunque proposta nei confronti degli stessi in relazione all’accordo, salvo che tali responsabilità , perdita, azione, procedura, costo, spesa, onere o danno ovvero conseguenza e azione derivino da comportamenti gravemente colposi o dolosi di Vamos in Sailing.
6. PROPRIETĂ€ INTELLETTUALE
Vamos è proprietaria della Piattaforma, delle sue componenti tecniche, grafiche e testuali, ad eccezione dei contenuti forniti dagli stessi Utenti o da terze parti. Più specificamente, la Piattaforma è realizzata mediante software concepito e sviluppato da Vamos, alla quale appartengono o sui quali la società detiene i diritti di proprietà intellettuale.
Vamos è, pertanto, l'unico soggetto detentore o licenziatario dei diritti di proprietà intellettuale riguardanti la Piattaforma, i suoi contenuti il software e i dati che ne assicurano il funzionamento. L'utilizzo della Piattaforma non concede all’Utente alcun diritto su tali elementi, fatti salvi i diritti attinenti ai contenuti forniti dallo stesso Utente.

Storage period

The individual using Vamos in Sailing who, unless otherwise specified, is the Data Subject.

Traveller Policy

The following are the policies relating to , cancellations and refunds of bookings made on the Platform.
These policies apply to all Experiences, with the exception of those for which the specific policies of the experience organizer prevail, as eventually indicated in the "Payments and Cancellations" section on the page of each Experience.
This document constitutes an integral part of the General Conditions.
Definitions
Provider: is a user registered on the Platform enabled to request the publication of Experiences.
Traveller: is a registered user on the Platform interested in taking part in the Experiences proposed by the Providers.
Minimum Crew: The minimum number of people who must participate in an Experience in order for it to be Confirmed. This value is defined by the Provider when creating the Experience.
Confirmed Experience: is an Experience whose start date has been confirmed by the organizing provider, who then commits to running it.
An Experience may be in Confirmed status from the moment it is created or may be in Confirmed status when the minimum number of participants is reached. Additionally, regardless of the number of participants, the Provider may confirm an Experience at any time prior to departure. When a previously unconfirmed Experience is upgraded to Confirmed status, all travelers on board receive an email notification of the upgrade.
Experience Price: indicates the price to participate in an Experience, expressed as a price per person and/or, for sailing experiences only, as the price to reserve the entire boat.
Cancellation of a booking by the Provider
From the moment you make a reservation for an Experience, the Provider organizing it has 24 hours to cancel your reservation. This may occur mainly in case the Provider has not updated the availability of seats and Vamos has more seats available than the actual number of seats for the selected Experience.
Vamos is a community based on trust and transparency. For this reason, the Provider always has the right to cancel your reservation, even after 24 hours from the time of booking, if you have filled in your profile with inaccurate or untrue information (e.g. age, gender, etc.) or if you have failed to inform the Provider of any special needs (e.g. diets, medication, need to bring pets, etc.) or physical conditions that might jeopardize your safety during the Experience.
In the event that the Provider cancels participation in an Experience, you will be refunded the full amount paid.
Cancellation of a reservation by the Traveller
If the Experience you have booked is in Unconfirmed status, you may cancel your reservation and receive your money back, except for the cost of any additional Vamos services selected during the booking process.
If the Experience you have booked is in a Confirmed status, you can cancel it and receive your money back, excluding the cost of any additional Vamos services selected during the booking process, only if there are 30 or more days to your departure date. To cancel your Reservation, please contact Customer Care.
Otherwise, you are not entitled to a full or partial refund of the amount paid. In the
event the Provider manually confirms the Experience before the minimum crew size initially requested is
reached, you have the right to cancel your reservation within 48 (forty-eight) hours of receiving the email notifying you of the Experience confirmation.
Cancellation of the experience
Experiences may be deleted for the following reasons:
Failure to Meet Minimum Crew:
If an Experience does not meet the Minimum Crew or is not independently confirmed by the Provider by the departure date, the Experience will be cancelled.Provider's unavailability or technical problems with the boat:
If, due to some serious unforeseen circumstance at the time of embarkation, the Provider is unable to perform the Experience or the boat has serious technical problems that prevent safe operation, the Experience will be cancelled.
Refund If
an Experience is cancelled, you are entitled to a refund of the amount paid, unless you have previously cancelled your reservation.
In no other case, including, but not limited to, force majeure, bad weather or other factors that prevent the full enjoyment of the boat or the performance of the planned program, you are entitled to a refund, in whole or in part, of the amount paid.

Traveller: is a user - registered on the Platform - interested in taking part in the Experiences proposed by the Providers.
Minimum Crew: The minimum number of people who must participate in the Experience in order for the Experience to be Confirmed. This value is defined by the Provider when creating the Experience.
The Provider CANNOT change this number after the Experience is published, but can still confirm the Experience regardless of the number of participants.

Confirmed Experience: is an experience whose start date has been confirmed by the organizing provider, who then commits to performing the experience.
An experience may be in Confirmed status from the time it is created or may be in Confirmed status at a later date. When a previously unconfirmed Experience is placed in Confirmed status, all Travellers participating in the Experience will receive an email notifying them of the status change.
Note: a Confirmed Experience is up to 70% more likely to receive applications from Travellers, but the organizer is bound to carry it out, regardless of the actual number of participants at the time of departure.
Experience Price: indicates the price to participate in an Experience, expressed as a price per person and/or, for sailing experiences only, as the price to reserve the entire boat.
Collection of participation fees and payments
When you organize an Experience on Vamos, you have to define how many people make up the Minimum Crew - that is, the minimum number of participants to be able to confirm the Experience and thus commit to it - and how much the Experience Price is.
Vamos will collect the individual participation fees from the Travellers participating in the Experience on your behalf and pay them to you, less the cost of using the Platform (the "Provider Service Fee"), within two business days of the start of the Experience.
Note: If a Traveller makes a reservation for an Experience more than 45 days before his/her departure date, he/she may choose to pay a deposit of 30% of the Experience Price and the balance within 30 days of departure.
Cancellation of Experience by Provider
Unconfirmed Experience
If, for some reason, you are forced to cancel an Experience you are organizing and the Experience is not Confirmed - you can cancel the Experience at any time without penalty.
Experience Confirmed
If for some serious reason, you are forced to cancel an Experience you are organizing and it is already Confirmed, you must immediately notify us of your unavailability. Vamos will, in this case, cancel the Experience and refund to the Travellers the amounts paid by them. You will be charged the Provider's Service Fee on the bookings made by Travellers up to that moment.
Cancellation of a reservation by a Traveller
As long as the Experience is Unconfirmed, the Traveller may choose to cancel his reservation at any time. In this case, if the Traveller cancels, Vamos will refund to the Traveller the amount previously paid for the reservation.
If, on the contrary, the Experience is Confirmed, the Traveller can choose to cancel his reservation up to 30 days before the departure date. The Traveller will be entitled to a refund of the amount paid for the reservation. If there are less than 30 days before the departure date of the Experience, the Traveller will not be entitled to a refund of his or her reservation; the amount paid by the Traveller will be retained and paid to you along with the other participation fees, less the Service Fee charged to the Provider. In return, you agree to keep the Experience Confirmed.
In the event that the Traveller has chosen the instalment payment scheme for the Experience and fails to pay the balance within the policy timeframe, the relevant booking will be cancelled, and the associated places will be made available again on the Platform. In this case, any payment on account already received on your behalf will still be paid to you, less the Provider Service Fee.
Skipper code of conduct
1. Compliance with regulations
The skipper undertakes to operate in compliance with all the laws and customs in force and applicable in the navigation area and to the proposed activity and with those provided for in his own country and in the country where the boat is registered.
In particular, the skipper, during the development of the experiences published on the platform, guarantees to his crew the respect of the applicable fiscal and navigation regulations.
By publishing an experience on Vamos, the skipper declares, therefore, to be in possession of the titles, qualifications, permits and authorizations necessary to carry out the proposed activity as well as to be in order with all the fiscal and administrative fulfilments required for the activity he proposes and carries out.
The skipper also undertakes to accept the feedback from passengers at the end of the holiday, provided that it is not defamatory and subject to the right of public reply.
2. Conduct of experiences at sea
The skipper is committed to conducting the experiences he proposes in the safest possible conditions, evaluating from time to time the conditions, the capabilities of himself and the crew, the characteristics and condition of the boat, the conditions and weather-marine forecasts and choosing accordingly the activities to be carried out for the success of the experience.
The skipper also undertakes to keep the boat in a good state of maintenance, dedicating to this aspect adequate resources and attention to ensure safety and comfort on board. Before each departure, the skipper will take care to verify that all components, equipment and facilities on board are in a state of efficiency to allow his crew an optimal experience of travel and navigation.
3. Communication to the crew
Before the departure of the experience, within the published form, in response to requests received and every time he receives a booking request, the skipper undertakes to provide adequate information about the proposed experience and to verify the suitability of the same with respect to the expectations, preparation and personal characteristics of the user, in order to allow the same to make an informed choice and to ensure a safe experience compatible with the characteristics and expectations of the user.
Moreover, it undertakes to provide all embarked users, before the boat leaves the moorings, with the necessary information regarding the rules of behaviour, the use of the equipment on board, the manoeuvres in which they may be required to participate, the position and use of personal and collective safety equipment and the procedures to be adopted in case of emergency.
The skipper, as the contact person for the whole crew, commits himself to communicate all the main choices related to the organization and the program of the experience, sharing the motivations and acknowledging where possible the wishes of the crew members. In particular, the skipper commits himself to communicate promptly to the crew any event or condition that involves changes in the program compared to what was initially established.
4. Eco-friendly tourism and respect for the sea
Vamos believes that the environment is a common and primary good. The skipper is committed, therefore, not only to comply with all applicable laws on environmental protection, but also to take action to ensure the preservation and protection of the marine environment.
The skipper commits himself to avoid behaviors that may damage the local environment and undertakes to spread the culture of environmental protection to the people he will host on board.
In fact, it is the precise duty of every skipper to make his crew respect the main environmental regulations, making sure that the crew adopts the most virtuous behaviors in terms of management of energy and water supplies, in terms of management, collection and disposal of waste, in terms of discharge into the sea of substances likely to contaminate water and cause damage to marine flora and fauna.
5. Spreading the passion for the sea and sailing
The Vamos community is made up of people who have already approached the world of sailing holidays before, as well as newcomers to this type of experience for the first time. Vamos promotes the spreading of the passion for sailing and for the sea.
In addition, the choice to navigate by hosting people on board implies a proper and responsible management of the group and the transmission of values that can facilitate the coexistence between people, who often do not know each other, in small spaces, and who will have to share all the time together for the duration of the experience.
6. Use of the platform
The community is a meeting place for people who share a passion for the sea and for boating holidays.
The skipper is committed to ensuring an open and friendly environment, maintaining a respectful attitude towards each member of the community and providing the best possible information in response to questions received from users. The skipper verifies and declares to be in full possession of the rights of the contents published within Vamos, including photos, videos and texts.
Each skipper commits himself to provide, both in his public profile and in the cards related to his proposals, true and complete information, which allow the users to make a conscious choice in compliance with their expectations. It is the skipper's responsibility to keep the information updated on the platform, both in his personal profile and in the experience cards. In particular, the repeated failure to update the available places on board and the failure to update the information concerning the boat used, the itinerary and the places/times of embarkation and disembarkation, could result in the user being removed from the platform.
The skipper also undertakes to accept the feedback from passengers at the end of the holiday, provided that it is not defamatory and subject to the right of public reply.
7. Cancellations
The skipper commits himself to avoid by all means the cancellation of his published experiences.
In the case of serious impediment to complete an experience, it is the skipper's duty to promptly inform the users on board and Vamos, so that it can be activated to find an alternative solution and minimize the inconvenience for the crew.
